In readiness for the Christmas Break, we have a surprise announcement today from IPO, of the Government’s latest response to its proposal on “Modernising Copyright: a robust and flexible framework”. At first reading, the paper appears to include a number of inconsistencies that will need careful assessment by right holders. Purported recognition of the importance of the three-step test will be tested directly by some of the latest recommendations.
