The BCCs response to the second part of the Technical review of draft legislation on copyright exceptions can be found here. This response covers Data analysis for non-commercial research, Education and Research, Libraries and Archives. It repeats the separate comment on the Contract Override provisions included in exceptions. The BCC also repeats its general reservations on the extent to which Government’s proposals are in line with European legislation and recent case law, the potential consequences resulting from poor definitions used in the draft legislation, the quality of the evidence base used and on which an assessment of the effect of each exception is based and the extent to which each proposal implements Government’s stated policy. The BCC also highlights the need for fair dealing linked to the three step test to be explicit in law, particularly where applied to new exceptions. Clear and easy to understand legislation is in the interests of rights holders and users.
